Programa de Mediación de Divorcio Obligatorio

¿Cuál es la exigencia?

Comenzando el 2 de mayo de 2005, en cualquier ocasión que una respuesta a una petición de divorcio sea archivada y que incluya preguntas de competición, los partidos participarán de buena fe al menos que haya una sesión de mediación.

¿Qué significa esto?

La exigencia significa que, si después de que una respuesta es archivada a una queja de divorcio y hay preguntas en la disputa, los partidos participarán en mediación para tratar de resolver las preguntas de la disputa. Los partidos participarán en mediación, al menos una sesión de mediación, pero seguirán a menudo trabajando con el mediador para resolver todas las preguntas del divorcio. Si después de una sesión, los partidos no sienten que la mediación les va a asistir en la resolución de sus preguntas , ellos pueden avanzar en el proceso de tribunal.

Que es el Mediación?

La Mediación es un proceso en el cual un facilitador tanto con partidos para tener una discusión significativa sobre las preguntas disputadas como con ayuda a los partidos a explorar opciones posibles para la resolución. El mediador no dice a los partidos como solucionar las disputadas, tampoco ellos ofrecen el consejo legal o su opinión sobre las preguntas . El mediador trabaja con los partidos hasta que encuentren una solución mutuamente agradable o hasta que esté claro que ningún acuerdo puede ser alcanzado. Si un acuerdo es alcanzado, el mediador escribirá un memorándum no obligatorio del entendimiento que los partidos suelen redactar una estipulación y la orden por el tribunal. Si ningún
acuerdo es alcanzado, el mediador relatará la participación de partidos al tribunal y ellos pueden circular a un proceso sobre las.

¿Quién paga al mediador?
